Consent form for the processing of personal data in the selection process
Your opt-in aims to record the free, informed, and unequivocal expression by which you, Data Subject of Personal Data, agree to the processing of your personal data for a specific purpose, in accordance with Law No. 13,709 - General Personal Data Protection Law (LGPD).
By accepting this term, you agree that the company NEW MAX INDUSTRIAL LTDA, a private legal entity registered with the CNPJ under number 67.534.560/0001-05, headquartered at Rua do Marceneiro, 179 – Jardim Werner Plaas, Americana – SP, CEP 13.478-722, email: dpo@newmaxindustrial.com.br, hereinafter referred to as Controller, make decisions regarding the processing of your personal data, as well as process your personal data, involving operations such as those related to the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, filing, storage, elimination, evaluation or control of information, modification, communication, transfer, sharing, dissemination, or extraction.
Personal Data
The Controller is authorized to make decisions regarding the processing and to process the following personal data of the Data Subject: Full Name, Profession, Education Data, Professional History, CPF (Individual Taxpayer ID), RG (ID Card), Class Registration, Email, Telephone, Address, Marital Status, Nationality, Photo, Number of Children, Position, Salary Expectations, Marital Status, Level of Education, Color, Race, Affiliation, Date of Birth, Place of Birth, PIS, Work Permit, Voter Registration, Military Service, Dependent Data, Clothing Size, Previous Employment, Signature, Profile Assessment, Political Exposure, Criminal Conviction Data, Sensitive Data Related to Occupational Health.
Purposes of Data Processing
The processing of personal data listed in this term has the following purposes:
- Enable the Controller to identify and contact the Data Subject for the purposes of preliminary steps for the selection and recruitment process;
- Enable the Controller to apply behavioral tests to the Data Subject, through a specialized company or otherwise, including occupational profiling, psychological tests, and medical examinations.
- Enable the Controller to carry out activities focused on analyzing conflicts of interest and/or due diligence of the Candidate/Holder, focused on integrity analysis, in order to identify situations that may compromise the ethics and integrity of the Controller.
- Enable the Controller to share the Data Subject's personal data with operators (service providers/specialized companies) in due diligence activities, medical examinations, tests, and others, for the proper selection and recruitment process.
- Enable the Controller to keep the Data Subject's data stored in case of rejection in the selection process, so that the Controller can contact the Data Subject to offer new vacancies.
Data Sharing
The Controller is authorized to share the Data Subject's personal data with other data processing agents, if necessary for the purposes listed in this term, observing the principles and guarantees established by Law No. 13,709.
Data Security
The Controller is responsible for maintaining security, technical, and administrative measures to protect personal data from unauthorized access and accidental or unlawful situations of destruction, loss, alteration, communication, or any form of inappropriate or unlawful processing.
In accordance with Article 48 of Law No. 13,709, the Controller shall notify the Data Subject and the National Data Protection Authority (ANPD) of any security incident that may pose a risk or cause significant damage to the Data Subject.
End of Data Processing
The Controller may retain and process the Data Subject's personal data for as long as it is relevant to the purposes listed in this term and for up to two years after the end of the selection process in the event of withdrawal or rejection, in order to comply with the labor statute of limitations. Anonymized personal data, which cannot be associated with the individual, may be retained indefinitely.
The Data Subject may request via email or correspondence to the Controller, at any time, that the Data Subject's non-anonymized personal data be deleted. The Data Subject is aware that it may be unfeasible for the Controller to continue the selection process after the deletion of personal data, resulting in the Data Subject's withdrawal/rejection.
Rights of the Data Subject
The Data Subject has the right to obtain from the Controller, in relation to the data processed by him/her, at any time and upon request:
I – confirmation of the existence of treatment;
II – access to data;
III – correction of incomplete, inaccurate, or outdated data;
IV – anonymization, blocking, or deletion of unnecessary, excessive, or unlawfully processed data in accordance with Law No. 13,709;
V – portability of data to another service or product provider, upon express request, in accordance with national authority regulations, observing commercial and industrial secrets;
VI – deletion of personal data processed with the consent of the data subject, except in the cases provided for in Article 16 of Law No. 13,709;
VII – information on public and private entities with which the controller has shared data;
VIII – information about the possibility of not providing consent and the consequences of refusal;
IX – revocation of consent, pursuant to § 5 of Article 8 of Law No. 13,709.
Right to Withdraw Consent
This consent may be revoked by the Data Subject at any time by sending a request via email (dpo@newmaxindustrial.com.br).
Attention! Failure to provide consent will prevent you from applying for the position, as it will not be possible to participate in the selection process without the processing of data in accordance with the above terms.
